it's relatively quiet here at the white house. yesterday we had kellyanne conway trying to frame up the day. and that remarkable ping-pong match between trump and speaker pelosi. today, since the president's capitulation, it's been relatively silent on the issue of the state of the union. let me just read how the president gave in to nancy pelosi last night. he said, i will do the address when the shutdown is over. i'm not looking for an alternate venue for the state of the union address and then says because there is no venue to compete with the history, tradition and importance of the house chamber. so, you know, when you look at the president's schedule today, as you well know, it's wide open. there's opportunities for him to maybe add something, but there isn't a really clear way for him to get his message out today other than by tweeting and so far, most of his tweets have been off the state of the union. hallie? >> i want to thank hans nichols, mar a mariana atencio. >> i want to bring in aaron blake, senior political report

house will claim executive privilege, that's what they did with pretty much all of the white house witnesses that we called in. so we're in a world of litigation and contempt proceedings and working on what exactly executive privilege comprises. and it will be a while. >> the president could just clear it up and release those notes say exactly what happened. but do you think there is a legal standing at all to try to get those notes? >> it is an interesting legal question. if there is a subpoena served and very likely trump's team will assert executive privilege, now we're into unknown legal territory. here is my read on it. on the one hand executive privilege is designed to protect communications between the president and his own top advisers. his lawyer. his attorney general, his cabinet members, his chief of staff. and to argue that now we should extend that to foreign heads of state? that is a serious extension of executive privilege and i think that it seems unlikely. on the other hand, this is sort of conversely, the richard nixon decision from 1974 is really the leading decision we ha

how would this sort of thing work in a normal white house? joining us now is chris lu who was white house cabinet secretary in the obama administration. thank you for your time. >> thank you. >> if the deputy white house chief of staff faced credible allegations of corruption and self-dealing, who is supposed to look into that in a normal white house? >> well, in a normal white house that person would have been out on the street so quickly. literally every single day of this white house i thought to myself if i did something like this i would have gotten fired. i mean this stinks on so many levels. you have somebody who's staying on government payroll without working, which is offensive even if we weren't in the middle of a government shutdown. you have somebody who abuses their authority to try to get a legislative fix to help only themselves. you have a 36, 37-year-old who wants to claim early retirement after 15 years. this is the definition of a swamp. and in a normal white house you'd have a chief of staff and president who would set hig
